David Hayes

Fenwick & West LLP, Advisory Board Member

Mr. Hayes is a Partner in the Intellectual Property Practice Group of Fenwick & West LLP. He specializes in intellectual property counseling, litigation and audits as well as technology licensing and transfer. He is a registered patent lawyer. Mr. Hayes represents numerous clients on high profile, complex technology transactions, including patent license transactions and acquisition strategies for both component technologies and turnkey systems, and counsels on complex open source issues. He is a nationally recognized expert on copyright issues related to the Internet and digital media and is the author of the 700+ page treatise “Advanced Copyright Issues on the Internet.” Mr. Hayes has authored dozens of publications on intellectual property law topics and six technical papers on various electrical engineering topics. He has testified before Congress and several federal agencies concerning various intellectual property issues.

Mr. Hayes graduated from Rice University (B.S in Electrical Engineering, Summa Cum Laude, 1978), Stanford University (M.S. in Electrical Engineering 1980), and Harvard Law School (J.D., Cum Laude, 1984) where he was an Editor of the Harvard Law Review (1982-1984).

Mr. Hayes serves on the advisory board for the Defensive Patent License (and co-authored a white paper on the DPL with Eric Schulman, with each acting in his personal capacity), the program planning committee of the USC Intellectual Property Law Institute, the advisory board of the Berkeley Center for Law & Technology, and the editorial boards of The Computer & Internet Lawyer, The Cyberspace Lawyer, The Intellectual Property Strategist, The Journal of Internet Law and Intellectual Property Counselor. He helped to draft the License on Transfer (LOT) community patent license.
